JS opened the hearing.

JS read a request for a continuance from the applicants’ attorney.

Family Apartment Request

The legal ad was read. All fees have been paid. Mr. Conti stated him and his wife would like to put on an attached 3-car garage with addition above. They spoke with the health agent and were told their septic could accommodate up to 4 bedrooms in total. If we make just a one-bedroom apartment then we would be all set. If we make a 2-bedroom apartment then we would have to increase our septic capacity. JS asked the applicant if the home has been in legal occupancy for 2 years or more. Mr. Conti stated it has. JS acknowledged their proposed plot plan showed they can put on the addition without a need for a Special Permit or Variance. They did speak with the Health Agent in regards to the Septic System and understood that. Mr. Conti stated they had ample room for parking. He (Mr.
Conti) stated he would remain in the principal residence and the in-laws (Otto & Helga Reckert) would occupy the proposed apartment. They were seeking this apartment for the in-laws as they are aging they need more care and their own property was becoming a burden for them to care for. AP asked about the one bedroom and/or 2 bedroom as they didn’t state exactly what there were putting. Mr. Conti stated it would not change the footprint of the layout. It would be an office and a bedroom or 2 bedrooms. JS stated the board votes on the footprint. Mr. Conti had questions as to what happens if the in-laws move out or pass on. JS explained that the stated when the stated occupants move on the Special Permit goes away. The applicant must come in and re-apply for new family members. Otherwise it goes back to a single family home. BS asked about the physical connection between he units. Mr. Conti stated it is
attached. BS asked about the access into the new apartment. Mr. Conti stated there would be a door from the apartment to the 3 car garage. AP suggested a doorway into their own home might be a good idea for any emergencies. JS stated that if the home is sold then the permit is no longer valid. The owners must come in every 5 years to renew the special permit. There were residents in attendance. What they wanted to confirm was that there would be no business operations, they couldn’t rent out to just anyone when in-laws left and could they advertise as an in-law apartment. JS confirmed there could be no business operations and when parents left the permit was no longer valid, which was the case when the property was sold. Any future new owners of the property would have to come for a new special permit.

There is a 20-day appeal period from when it is put in to the Town Clerk.

AP motion to recommend the changes JD brought forth.
